The transport contract with the Bergbahnen Silvretta Galtür (in the following referred to as “Bergbahnen”) is concluded only under the terms of these General Terms and Conditions. Conflicting conditions will not be accepted. These General Terms and Conditions, the Tariff Conditions, the officially approved Conditions of Carriage and the Rules of Conduct of the International Ski Federation (FIS Rules) are part of the Carriage Contract.

The General Terms and Conditions, the Tariff Conditions and the Rules of Conduct of the International Ski Federation (FIS) are available to everyone on the Internet at www.silvapark.at and can also be consulted at the main ticket offices on request. The conditions of carriage are set out at the entrance to the lift aids and are also available for inspection at the ticket offices. When purchasing a Snow Card Tirol, the Freizeitticket Tirol or the Regio Card Tirol, their respective terms and conditions – unless they contradict these terms and conditions – also become part of the contract. The terms and conditions of these card groups are available on the homepage of the Snowcard Tirol, the Freizeitticket Tirol or the Regio Card Tirol.

A prerequisite for using the cable cars is the purchase of a valid ticket.
The transportation will take place after an access control.

If the customer acquires a (combined) ticket for the use of facilities of several companies, the cable cars act for the other companies only as their representatives.
The services that can be used with such a (combined) ticket are provided by legally independent companies.

Therefore, it is always the responsibility of the company in whose ski area an accident has occurred to provide the individual services and for the consequences of any accidents; contractual claims (e. g. for securing the slopes or transport) are therefore handled by the company in whose (ski) area an accident has occurred.

Unless otherwise agreed, the fee announced by the cable cars at the time of the conclusion of the contract shall be paid for the purchase of the respective tickt.

All ski passes of the ski region Galtür in Tyrol are issued on a key card! The deposit fee is € 5.00. Undamaged, functional chip cards can be returned at the sales points of the Bergbahnen Silvretta Galtür, Intersport Wolfart, Sport Walter and at the ski pass sales points in Ischgl, Kappl and See.

If individual days of a multi-day ticket fall into different seasons, the exact mixed price will be charged.

Ticktes can be issued at reduced rates only upon presentation of appropriate proof (e. g. valid photo ID).

All prices are in EUR including the statutory VAT. Payment has basically to be made in advance. Payment options at the ski pass box office: Cash in euros, ATM card (Maestro), credit card (VPAY, VISA, Mastercard, AMEX).
Information in brochures, newsletters, catalogues, advertisements, price lists etc. is non-binding, subject to change and the prices announced at the time of purchase of the ticket apply.

A valid ticket must always be taken with you during the use of the mountain railways transport service and, if requested, show it to the employees of the mountain railways.

If a customer carries a discounted ticket, he must present proof of the existence of a reason for the discount when checked by employees of the cable cars.

If he does not provide this proof immediately or within 24 hours at the latest, the ticket will be withdrawn without replacement.

In this case, the cable cars are also entitled to charge a handling fee of € 50.00

Multi day tickets are valid only on consecutive days, unless a different period of validity has been expressly stated (e. g. election ski passes).

Ticktes may not be transferred to third parties, resold, etc. without the prior written consent of the cable cars.

When using the transportation services of the mountain railroads, a valid ticket must be carried and presented upon request in the control zones (i.e. the entire area of the mountain railroads, including slopes and ski routes) so that it can be checked whether the services of the mountain railroads are being used correctly. Failure to do so may result in the ticket being blocked and transportation being refused.
 
The valid ski pass entitles the holder to use all facilities in operation within the period of validity in accordance with the tariff and transportation conditions and these GTC. The ski pass is not transferable. Subsequent exchange for another ski pass and changes to the period of validity are not possible. Ski passes that have not been purchased at the authorized sales points of the mountain railroads, lost ski passes and ski passes that have been improperly purchased or used will be blocked. Misuse, such as unauthorized passing on of a ticket, will lead to withdrawal without compensation and the obligation to pay a penalty of at least € 50 as well as compensation for damages. The Bergbahnen also reserves the right to press criminal charges.  

In the event of a breach of the conditions of carriage, failure to comply with the closure of ski runs (e.g. due to avalanche danger), the ban on skiing in forest areas or the FIS rules, you will be excluded from further carriage. In serious cases and in the event of repeated violations, the ski pass will be withdrawn without replacement and a criminal complaint will be filed with the authorities. In all other respects, the instructions of the employees of the mountain railroads must be followed, as they serve the safety and order of the ski operation.

 

Due to the COVID-19 pandemic, the customer has been aware since March 2020 that the operation of companies and also of mountain railroads could be completely and permanently discontinued by official orders due to circumstances beyond their control (such as the consequences of the pandemic). If the customer purchases a ticket during an officially ordered closure, there is no entitlement to a (pro rata) refund, extension or postponement of its period of validity.

When purchasing the ticket, the customer is also aware that due to the global COVID-19 pandemic, (renewed) officially ordered closures or closures of individual cable car facilities, individual companies, entire regions, borders, etc. may occur at any time. Even in these or comparable cases, there is no entitlement to a (pro rata) refund, extension or postponement of the validity period of the ticket.

 

the announced start and end dates of a season as well as the announced operating times are not “fixed dates” and depend on various circumstances - such as the weather. Therefore, there is no entitlement to a refund or extension of the ski pass even if the season starts later, ends earlier or the operating times are reduced. In the early and late season, limited lift and piste availability is also to be expected, particularly due to weather conditions.

If the customer is prevented from (further) use of his/her ticket due to accident, illness, etc., there is no entitlement to a (pro rata) refund. However, in the case of multi-day tickets, the mountain railroads may grant a pro rata refund as a gesture of goodwill on presentation of a certificate from a registered doctor (confirming that the customer can no longer practice winter sports for the remaining period of validity), presentation of the proof of purchase and return of the ticket before the expiry of the period of validity.

However, there is no legal entitlement to this. Any refund will be made against a processing fee of € 11.00. This goodwill refund cannot be made for day tickets and one-way tickets.

Refunds can only be made with the cable car company from which the ski pass was purchased. 

It is not possible to exchange, extend or postpone the period of validity of a ticket.

If a ticket is lost, a replacement ticket will only be issued once. A processing fee of € 11.00 plus a deposit fee of € 5.00 for the contactless data carrier will be charged for the issue of a replacement ticket. The replacement ticket is valid for the remaining contract period after issue, the lost ticket will be blocked.

No replacement ticket can be issued for a forgotten ticket.
 

The mountain railroads are not liable for damages caused to a customer by the behavior of third parties if these third parties are not attributable to the mountain railroads or if they are not subject to their instructions. 

The transportation contract is only concluded for the use of the open facilities and slopes or ski routes during the operating times announced in each case. Contractual claims against the mountain railroads therefore only exist for the duration of the operating times and only for open pistes/ski routes. 

Use of the free ski area is at your own responsibility and risk. No safety or marking measures (e.g. safety measures, controls, barriers, etc.) are taken in the open ski area. Any measures taken in exceptional cases are voluntary and do not constitute any obligation on the part of the cable cars.


 

The customer is obliged to comply with the FIS rules.

In general, nature and other visitors to the ski area must be treated with respect and responsibility when practicing the sport. This includes, in particular, keeping a safe distance from snow groomers, skidoos and snow machines. Any soiling, throwing away of garbage, cigarettes etc. must be avoided.

The permitted way of transporting children is regulated in the conditions of carriage of the mountain railroads. These conditions of carriage are posted at the entrances to the lifts and must be observed.
The following generally applies:

- Children under 1.10 m tall may only be transported if accompanied by an adult on the next seat or on their lap.
One adult per child.

- Children between 1.10 m and 1.25 m tall must be accompanied by an adult in the next seat. Maximum 2 children per adult (chairlift).

- Children taller than 1.25 m are transported as adults.

 

Tickets for pedestrians are only valid for transportation without winter sports equipment. Pedestrians may not enter the piste area and must only use the winter hiking trails. 

Tobogganing is not permitted on ski slopes.

Instructions from cable car staff and the piste rescue service must be followed, as these serve to ensure the safety of all users of the ski area and to prevent accidents, damage, etc.

The costs of a rescue after an accident are not included in the price of the ski pass and must be borne by the person involved in the accident.

In the event of avalanche danger, ski pistes and ski routes are closed and may therefore not be used or accessed. Avalanche blasting takes place during and after fresh snowfall. During this time, it is forbidden to ski on or enter areas affected and closed. 
The pistes and ski routes may no longer be used after the end of operating hours. During this time, grooming work takes place and there is a danger to life.

Web cams are installed at some of the facilities. These web cams record the surrounding area (e.g. the area around a mountain station, a section of a piste) in real time and without sound. The image data is broadcast in real time on television as well as on the website (www.galtuer.com) and the mobile app of Galtür and Paznaun-Ischgl to give guests and people interested in Paznaun an up-to-date impression of the weather and piste conditions (processing purpose). 

Although these web cams have a rather wide recording range and people are therefore not or only very difficult to recognize in the recordings, it cannot be completely ruled out that the web cams record image data as personal data. 

The use of the services of the mountain railroads requires various processing operations with regard to the personal data of visitors. The visitor acknowledges and agrees to the data protection declaration of the mountain railroads displayed at the ticket offices and also available at https://www.galtuer.com/bergbahnen-galtuer-datenschutz.

If and insofar as personal data is processed at all, the legitimate interests of the controller, which consist in achieving the purpose of the processing, form the legal basis for this data processing. In addition, reference is made to the data protection guidelines of the mountain railroads, which are also available at https://www.galtuer.com/bergbahnen-galtuer-datenschutz.

Disputes arising from this contractual relationship shall be governed exclusively by Austrian substantive law. The authentic contractual language is German.
